The priority date for EB-5 visa interview for Vietnamese investors in August 2021
Currently, the EB-5 program to immigrate to the US through the Regional Center has expired on June 30, 2021, so the program is temporarily suspending visa issuance.
According to multiple sources, it is likely that the Regional Center EB-5 program will continue to be approved and extended by the US Congress. Until then, the EB-5 Regional Center processing date will be updated in the Visa Bulletin.
USCIS is still working hard to process I-526 and I-829 petitions despite the program’s expiration
Case processing data shows that USCIS is still working on processing I-526 petitions, despite the temporary delay in the EB-5 regional center program.
Specifically, the data of the second quarter of 2021 on processing applications:
Form I-526:
The number of new applications increased by 367% compared to last year, the approval rate reached 85%
Processing time for I-526 petitions (without mainland China): 31- 49.5 months. About half of those were processed within 31 months. Most of the remaining applications are completed within 50 months.
Form I-829:
Quarterly growth is 414%, the approval rate is 94%
I-829 petition processing time: 35.5 – 88 months. Specifically, 50% of EB-5 investors’ I-829 petitions are processed within 35.5 months and most are completed within 64 months.
USCIS is currently actively issuing many priority policies on handling backlogs, reducing complicated claim procedures. Therefore, both these positive trends will continue in 2021 and 2022.
Along with the program officially returning to the $500,000 mark, the EB-5 US immigration program continues to be considered the safest way to get a US green card, so that children have an opportunity to enjoy top education and investors can participate in the large business market.
