EB-5 Backlog Status and Advice for Vietnamese Investors

Current EB-5 Backlog

The EB-5 program is currently facing a significant backlog of applications, which is impacting the waiting time for investors to receive their green cards. According to data from the American Immigration Investment Association (AIIA), as of April 2024, there are a total of 3,278 I-526E applications pending, including:

  • Targeted Employment Area (TEA): 2,185 applications (63%)
  • Rural Area: 1,093 applications (32%)

Reasons for the Backlog

There are several factors that have contributed to the EB-5 backlog, including:

  • High investor demand: The EB-5 program has become increasingly popular with international investors, particularly from China and India.
  • Limited EB-5 visa numbers: The U.S. government only issues a limited number of EB-5 visas each year.
  • Lengthy application processing times: The EB-5 application process can take several years to complete.

Impact of the Backlog

The EB-5 backlog can impact investors in several ways, including:

  • Longer waiting times: Investors must wait longer to receive their green cards.
  • Higher costs: The filing fees for EB-5 applications may increase.
  • Increased risk: The risk of having an EB-5 application denied may be higher.

Advice for Vietnamese Investors

To mitigate the impact of the EB-5 backlog, Vietnamese investors should consider the following:

  • Choose a rural EB-5 project: Rural EB-5 projects typically have faster processing times and higher approval rates.
  • File early: File applications early to avoid the backlog and the tripling of filing fees in April 2024.
  • Work with an experienced immigration attorney: An immigration attorney can help investors understand the EB-5 program regulations and prepare a complete and accurate application.
